Summary/Major Elements:
- Creates a seed laboratory advisory
group comprised of:
- Voting members from the Board of
Agriculture, organizations involved in seed production, the Wyoming seed industry, certified contact seed growers and one person interested in seed
quality.
- Nonvoting members who are the
director of the Department of Agriculture, the University of Wyoming
experiment station director, the head of the University of Wyoming
college of agriculture plant science department, the Wyoming seed
certification service manager and the state seed analyst.
- Establishes the terms and duties
of the seed laboratory advisory group.
- Modifies and adds definitions to
the seed statutes.
- Requires any person who conditions
grain or seed for hire to obtain a license.
- Exempts from licensing
requirements a person who has seed in storage for conditioning or cleaning
and the intended use of the seed is not planting and a resident grower of
seed who sells his seed to a licensed seed dealer.
- Exempts any charitable and
educational institutions from licensing requirements.
- Allows the department of
agriculture to establish lists of prohibited noxious weeds, restricted
noxious weeds and regulated weeds and to establish tolerances for
restricted noxious weeds and regulated weeds.
- Establishes a procedure to provide
for seed analysis and to set seed laboratory fees.
- Increases a penalty amount from
not more than $200.00 to not more than $750.00 and provides for
reimbursement of costs incurred by the department of agriculture.
- Repeals the definition of
"agricultural seeds", the old list of prohibited noxious weeds,
a duplicative rulemaking provision and certain prohibited noxious weed
seed quarantine provisions.
