Summary/Major Elements:
- Amends the underground storage tank program by requiring cathodic
protection on all internally lined underground storage tanks no later than
June 30, 2008.
- Requires underground storage tanks that dispense more than
500,000 gallons per month to have double walled tanks and lines no later
than June 30, 2012 or 30 years from the date of installation, whichever is
later.
- Amends the definition of "underground storage tank".
- Expands rulemaking authority to address the tank requirements.
- Requires the tank owner to register each new installation or modification
of a registered tank system.
- Requires financial assurance of at least $30,000.00.
- Requires proof of insurance of at least $2,000,000.00 if the tank
owner owns more than 100 underground storage tanks.
- Requires the tank owner to notify the department upon completion
of the installation or modification of the underground storage tank.
- Establishes a late payment penalty of $100.00 per tank or contamination
site.
- Increases the cap on the corrective action account to
$17,000,000.00 and raises the floor to $11,000,000.00. This account is
used to fund remediation of leaking tanks.
- Repeals the requirement to dismiss any suits or administrative
actions pending or ongoing in 1990 to be eligible for corrective actions.
