Catch Title:       Theft of fuel.

Subject:  Creates crime of theft of fuel and provides penalties.

Summary/Major Elements:

· A person who causes a motor vehicle to leave a gas station without paying for the fuel is guilty of larceny.

· First conviction is a misdemeanor punishable by a fine of not more than $750.00, not more than 6 months imprisonment, or both.  A second and subsequent conviction is punishable by a fine of not more than $1,000.00, imprisonment for not more than 6 months, or both.

· Provides for the suspension of the driver's license of a person convicted of theft of fuel two or more times.

· The driver's licenses suspension shall be 30 days for the second conviction and 90 days for each subsequent suspension.
