Summary/Major Elements:

· Expands school buildings included with major maintenance payment computations to include building square footage otherwise treated as closed or surplus but for use for provision of child care, developmental preschool and BOCES programs;

· Square footage used for such purposes treated as educational space under computational formula and does not count towards district square footage or excess capacity limitations under payment formula;

· Requires approval of School Facilities Commission, such use must be included in district facility plan and requires district lease agreements for such uses to be limited to one year;

· Fees or payments received by districts for such use must be reported as local district resource for purposes of foundation program computations;

· Limits school year 2007-2008 total statewide payments for expanded use purposes to $200,000, and directs Commission to reduce district payments proportionately if total statewide computations for expanded use exceed this amount.
