Catch Title:         Gambling-definitions.

 

Subject:              Amends statutes governing gambling.

 

Summary/Major Elements:

 

·      The act provides that profits from gambling do not include benefits of proprietorship where a bona fide social game is occurring.

 

·      The act creates new restrictions on charitable or nonprofit organizations conducting bingo games including:

 

·                     The organization shall have been in existence in the state for three years;

 

·                     The organization shall only use member volunteers or employees or contractors paid by the organization to operate the game;

 

·                     Players must be 18 years or older;

 

·                     Sixty-five percent of gross sales must be paid as winnings;

 

·                     No more than 40% of the net proceeds may be paid to distributors or manufacturers of supplies (which may be paid on a per card basis);

 

·                     Of the remaining proceeds, 75% must be donated to a charitable or benevolent purpose within one year.

 

·      The act defines charitable or nonprofit organization as one that possesses a valid 501(c) exemption from federal income tax.

 

·      The act defines a bingo game.

 

Comments: 

 

· The act must be read in conjunction with 2007 Session Law, Chapter 52, which repeals the portion of the act which defines "bingo game".
