Catch Title:       Felony driving under the influence.

 

Subject:  Amends the penalty for causing serious bodily injury while driving under the influence of alcohol or a controlled substance.

 

 

Summary/Major Elements:

 

·         Under current law, a person convicted of causing serious bodily injury to another while driving under the influence of alcohol or a controlled substance is subject to a penalty of imprisonment for not less than 6 months nor more than one year, a fine of not more than $2,000.00, or both.

 

·         This bill amends the penalty for a conviction under this law by eliminating the minimum mandatory sentence and increasing the maximum sentence to not more than 10 years.  The potential fine for a conviction under this law remains unchanged.
