Subject:  Clarifies that counties are responsible for the first 72 hours of emergency detentions of persons with mental illnesses.

 

 

Summary/Major Elements:

 

·         Under current law, the county is responsible for the first 72 hours of emergency detention of a person who is alleged to be mentally ill, or until continued emergency detention of the person is ordered.

 

·         This bill clarifies that the county shall be responsible for the first 72 hours of detention, plus any weekends and legal holidays within that period, regardless of whether or not continued emergency detention is ordered.  Thereafter, responsibility for costs of detention or involuntary hospitalization shifts to the department of health.
