Summary/Major Elements:

· Currently the law provides that an easement or agreement which does not specifically describe the location of the easement or which grants a right to locate an easement at a later date will be valid for a period of one (1) year from the date of execution of the easement or agreement, if the specific description is recorded within one (1) year of the easement or agreement.

· This bill provides that an option to obtain an easement at a later date shall not be considered an easement or agreement under that law.

· This bill provides that such options shall not exceed a period of seven (7) years.
