Summary/Major Elements:
· Under current law the military department does not have express authority to reimburse national guard members for uncompensated medical expenses incurred as a result of state active duty service.
· This legislation amends the law to provide that state active duty officers and enlisted men are entitled to receive reimbursement for "reasonable medical expenses paid by the officer or enlisted man as a direct consequence of state active duty." If a medical expense is paid by a third party (i.e. an insurance company), the expense is not eligible for reimbursement.
· This legislation gives the adjutant general authority to adopt regulations dictating when a medical expense is the consequence of state active duty.
