Subject:                     Amending election requirements for creation of water and sewer districts and election of board members.

Summary/Major Elements:

· Under current law, petitions for formation of a water and sewer district are filed in accordance with the Special District Elections Law of 1994.  Under that law, the qualified electors vote on the petition.

· This act provides a new definition of “electors” and “voters” to include qualified electors and landowners in the proposed water and sewer district.

· This act also removes the requirement that board members be “taxpaying” electors or voters of the district.
